Data Processor: Google LLC, located in the United States, acts as a data processor on our behalf.
Data Transfer: By using this chatbot, you acknowledge and agree that your personal data, including the content of your chat conversations, will be transmitted to and processed by Google in the United States. A transfer only takes place when you sent a query to the chatbot. Simply loading the chatbot doesn’t transfer any data.
Data Storage: The chat conversations are stored only on our servers, located in Germany, which is part of the European Union. Google, as our data processor, only processes the data to provide the chatbot functionality; Google does not store the chat conversations on its servers for its own purposes beyond the immediate processing required to operate the chatbot.

1. Description of Services

123aha.com offers an innovative, AI-powered learning platform that helps pupils and students understand and process learning content more efficiently. The service uses specialized AI Buddies to explain complex topics in an understandable way by linking them to personal hobbies or interests, and to jointly practice tasks, generate exercise sheets, and specifically for students, create automated learning scripts from lecture materials (PDFs). The goal is to increase learning success while gaining valuable free time. For this purpose, 123aha.com provides its customers with an internet platform where they can upload their learning materials or ask specific questions to the AI Buddies. Each service package supports different school subjects or fields of study and different functions within them (e.g., Practice Buddy, Explainer Buddy, Exercise Generator, or Script Generator for the student packages) and is limited in the number of daily AI requests or the number of document pages to be processed according to the selected package description. This limitation is necessary because the computing power for AI models incurs high costs and server load increases with the intensity of use. The service includes storage space for learning materials, data analysis, and the provision of generated learning aids and interactive chats.

2. Prices and Billing via Credits

123aha.com uses a digital wallet for its services, which customers can top up at any time. With a Starter Package, the customer gains access to our AI learning infrastructure for one or more school subjects or one or more fields of study. In addition, most Starter Packages already include credits, which are credited to the customer's digital wallet immediately after ordering the Starter Package. By purchasing a Starter Package, the customer enters into a contract for the respective subject or field of study, which costs the number of credits per month specified in the Starter Package. On the first day of each month, we deduct the number of stored credits from the customer's wallet for each activated Starter Package. If there are not enough credits, the contracts are simply paused until the customer repurchases credits. The great advantage for the customer is that they can use all credits, regardless of whether they were included in a Starter Package or repurchased, across all contracts. For example, if the customer has already booked "Mathematics" and credits are running low, they can either repurchase credits, or they can purchase, for example, the Starter Package for "Physics", which also contains credits that they can then use for Physics and Mathematics (or any other subjects they have booked). If you order during the current month, the fee for the first month will be charged pro-rata, so you only pay for the remaining days until the first of the next month.

3. Rights of Use

123aha.com grants the customer a simple, non-transferable right, limited to the duration of the contract, to use the platform and the generated content (e.g., learning scripts, practice exercises, chat responses) exclusively for private, personal use. Commercial use, resale, transfer, or public accessibility of the generated content is expressly prohibited.

All login data and access rights are personal and may under no circumstances be passed on to third parties or shared with other persons. The customer is obliged to keep their access data secret to prevent misuse by unauthorized persons. In case of justified suspicion of misuse or the sharing of account data, 123aha.com reserves the right to temporarily or permanently block access, without any claim for a refund of credits.

4. Right of Withdrawal

You have the right to withdraw from an ordered item within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of the conclusion of the contract.

For contracts concerning the provision of digital content (such as credits, AI learning support, automated script creation) or digital services, your right of withdrawal expires prematurely if we have already begun with the performance of the contract before the end of the withdrawal period.

The service of 123aha.com begins immediately with the provision of the digital wallet and the activation of the associated infrastructure, as well as the crediting of credits. With your consent to the commencement of contract performance before the expiry of the fourteen-day withdrawal period and your acknowledgment that your right of withdrawal expires with the commencement of contract performance, you no longer have the right to withdraw or to a refund of amounts already paid.

Consequences of withdrawal: If you lawfully withdraw from this contract (before a service has begun), we shall reimburse to you all payments we have received from you without undue delay and at the latest within fourteen days from the day on which the notification of your withdrawal from this contract has reached us. In no case will you be charged any fees for this repayment.

5. Accuracy of AI Content

123aha.com uses state-of-the-art AI models to generate learning content. The customer is aware that, according to the current state of technology, AI systems can hallucinate information or provide factually incorrect answers. The accuracy of the results also depends heavily on the quality of the uploaded source materials. To minimize errors, the Buddies are programmed to show learning paths instead of just providing final results. However, 123aha.com does not guarantee the factual correctness, completeness, or up-to-dateness of the generated content or the achievement of specific grades or examination objectives.

6. Availability

Although 123aha.com uses highly available cluster systems, outages cannot be ruled out. This can be due to the availability of external AI interfaces, necessary maintenance work, or disruptions in the data center. 123aha.com strives to keep such interruptions as short as possible but does not guarantee uninterrupted availability of the service.

7. Support Services

To offer attractive prices for pupils and students, the system is designed for simple self-service. An extensive FAQ section is available. Free personal support is not included in the price. However, technical errors can be reported by email at any time.

8. Liability

123aha.com assumes no liability for the use of the learning platform or for the AI-generated content. The platform serves as a support tool and does not replace the user's own examination of the material. 123aha.com is not liable for technical problems when accessing the website or the learning AI or accessing generated learning materials, insofar as these are beyond the control of 123aha.com. Liability for academic success (e.g., passing exams) is excluded. The customer shall indemnify and hold 123aha.com harmless in any case.

9. Use by Minors

123aha.com concludes contracts exclusively with persons of unlimited legal capacity (adults). Orders, account top-ups, and commissions may only be placed by these persons. Since the platform provides content generated by artificial intelligence, which in individual cases may contain unpredictable formulations, use by minor pupils or students is only permitted under constant supervision and in the presence of a legal guardian. The legal guardians assume full responsibility for the use and for the interpretation of the dialogues and content generated by the AI Buddies. Use in the presence of parents ensures that they can intervene at any time if they disagree with the type of communication or the content of the AI.

10. Termination

The contract can be terminated at any time in writing or via the customer account with 14 days' notice to the end of the month. Upon termination, all personal data and learning materials will be irrevocably deleted. Unused credits expire and will not be refunded.

11. Acknowledgment and Understanding

The customer confirms to have fully understood the system of AI Buddies and the billing via credits. There was always the possibility to clarify questions in advance.

12. Applicable Law

Austrian law applies exclusively.

13. Place of Jurisdiction

The place of jurisdiction is the Austrian court factually and locally competent for the registered office of 123aha.com.

14. Severability Clause

Should provisions be ineffective, the remaining points of the GTC remain unaffected.
